Terms of Service

Important: Clockwork Meal uses artificial intelligence to generate meal plans and recipes. AI-generated content may contain errors. You are responsible for verifying all ingredients are safe for you and your family, especially regarding allergies and dietary restrictions. This service is not medical or nutritional advice.

These Terms of Service ("Terms") govern your use of Clockwork Meal, operated by Clockwork Meal Pty Ltd ("we", "us", "our"). By creating an account, using the app, or purchasing a subscription, you agree to these Terms. If you do not agree, do not use the service.

1. The Service

Clockwork Meal is an AI-powered meal planning application available on iOS and the web at clockworkmeal.app. The service uses artificial intelligence to generate personalised 7-day meal plans, recipes, and shopping lists based on household preferences, dietary restrictions, and allergies you provide.

The service is designed for personal, household meal planning. It is not a medical service, dietetic service, nutritional counselling service, or food safety certification system.

2. Eligibility

You must be at least 13 years old to create an account. If you are under 18, you must have a parent or guardian's consent to use the service. Parents and guardians are responsible for any use by minors under their supervision.

You may add family members (including children) to your household profile for the purpose of meal planning. The account holder is responsible for the accuracy and safety of information provided for all family members.

3. Accounts & Security

You are responsible for maintaining the security of your account credentials and for all activity under your account. You must provide accurate information during registration and keep it up to date, particularly allergy and dietary restriction data.

Guest (anonymous) accounts are temporary. Data associated with a guest session may not persist if you do not create a full account. We are not responsible for data loss from guest sessions.

4. AI-Generated Content

Meal plans, recipes, shopping lists, and all other content generated by Clockwork Meal are produced by artificial intelligence. This content:

  • May contain errors, inaccuracies, or omissions
  • Is not reviewed by a nutritionist, dietitian, or medical professional
  • Does not constitute medical, dietetic, or professional health advice
  • Should not be relied upon as a substitute for professional guidance
  • May not account for every possible allergen, cross-contamination risk, or ingredient interaction

The AI uses the dietary preferences, allergies, and restrictions you provide to attempt to generate suitable meal plans. However, AI technology has inherent limitations and we cannot guarantee that AI-generated content will be free from allergens or errors.

Content is generated using third-party AI services (Anthropic Claude). Your dietary preferences and household information are sent to these services for processing. See our Privacy Policy for details on how your data is handled.

5. Allergy & Food Safety

Important safety information

  • You are solely responsible for verifying that all meals and ingredients are safe for you and your family members.
  • Always check actual product labels. Ingredients vary by brand, region, and may change over time.
  • The app's allergy filtering is a convenience tool, not a safety guarantee.
  • If you or a family member has a severe allergy, consult an allergist or medical professional before relying on any AI-generated meal plan.

Meal plans generated for families with children should be reviewed by the parent or guardian. The AI does not account for age-specific safety considerations such as choking hazards for young children or precise paediatric nutritional requirements. Where appropriate, consult a paediatrician or dietitian.

You must ensure the allergy and dietary restriction information in your profile is accurate and up to date. We are not responsible for adverse outcomes resulting from inaccurate, incomplete, or outdated information you provide.

6. Nutritional Information

Calorie counts, macronutrient values (protein, carbohydrates, fat), and other nutritional data shown in the app are AI-generated estimates only. They are not derived from laboratory analysis, certified food databases, or professional dietetic assessment.

Actual nutritional values vary depending on specific brands, preparation methods, portion sizes, and ingredient substitutions. Do not rely on these estimates for medical dietary management (e.g., diabetes, kidney disease, eating disorders). Consult a registered dietitian or medical professional for clinically accurate nutritional guidance.

7. No Professional Relationship

Using Clockwork Meal does not create a professional relationship of any kind between you and us — including but not limited to a doctor-patient, dietitian-client, or nutritionist-client relationship. We are a technology company providing an AI-powered planning tool, not a healthcare or nutrition provider.

If you have medical conditions, food allergies, eating disorders, or other health concerns that affect your diet, seek advice from a qualified healthcare professional before acting on any AI-generated meal plan.

8. Subscriptions & Pricing

Clockwork Meal offers the following tiers:

  • Free — Limited AI features, 1 active meal plan, 3 swaps per day
  • Plus — Expanded limits, plan history, additional family members
  • Pro — Unlimited swaps, full history, all features

Pricing varies by country. The exact price for your region is shown on the pricing page and at checkout. All applicable taxes (including GST for Australian customers) are included in the displayed price. For subscriptions purchased through the Apple App Store, Apple's regional pricing applies.

Payments for web subscriptions are processed by Stripe. By making a purchase, you agree to Stripe's Terms of Service. We do not store your full payment card details.

We may change subscription pricing with at least 30 days' notice. Existing subscribers will be notified before any price change takes effect.

9. Auto-Renewal & Cancellation

Subscriptions automatically renew at the end of each billing cycle unless you cancel before the renewal date. You will be charged the applicable subscription fee on each renewal date.

To cancel:

  • Web subscriptions (Stripe): Go to Settings → Manage Subscription, or contact us
  • iOS subscriptions (App Store): Go to iPhone Settings → Apple ID → Subscriptions → Clockwork Meal → Cancel

Cancellation takes effect at the end of your current billing period. You retain access to paid features until then, after which your account reverts to the Free tier.

10. Payment Failures

If a subscription payment fails, we may retry the charge over the following days. During this period, you may retain access to paid features at our discretion. If payment cannot be collected after reasonable retries, your subscription may be cancelled and your account downgraded to the Free tier.

We are not responsible for charges declined by your bank, expired cards, or insufficient funds. It is your responsibility to keep your payment method current.

11. Refunds

For web subscriptions (Stripe): If you believe the service did not meet its description or was not fit for purpose, contact us within 14 days of the charge to request a refund. We assess refund requests in accordance with Australian Consumer Law.

For iOS subscriptions (App Store): Refunds are managed by Apple. To request a refund, visit reportaproblem.apple.com.

Nothing in these Terms limits your rights under the Australian Consumer Law, including your right to a remedy if a service fails to meet the consumer guarantees.

12. Free Tier

The Free tier is provided at our discretion. We may modify, limit, or discontinue the Free tier at any time without notice. Use of the Free tier does not create an obligation for us to maintain the free service indefinitely.

Free tier users are subject to usage limits (e.g., daily swap limits, plan generation limits). These limits may change. Exceeding limits may require upgrading to a paid tier.

13. Acceptable Use

You agree not to:

  • Use the service for any commercial food preparation or restaurant operation
  • Reverse-engineer, scrape, or extract data from the service programmatically
  • Attempt to manipulate, bypass, or inject prompts into the AI system
  • Share your account credentials with others
  • Use the service to generate content that is harmful, misleading, or illegal
  • Circumvent usage limits, rate limits, or subscription restrictions

We reserve the right to suspend or terminate accounts that violate these terms.

14. Your Data

You retain ownership of the personal information you provide (family member names, allergies, dietary preferences, etc.). We use this data solely to provide and improve the service, as described in our Privacy Policy.

Your dietary preferences, allergy information, and household data are sent to third-party AI services (Anthropic, based in the United States) for meal plan generation. By using the service, you consent to this cross-border transfer for the purpose of providing the service.

Allergy and dietary restriction data may be considered sensitive information under the Privacy Act 1988 (Cth). We collect this data with your explicit consent, use it only to generate suitable meal plans, and handle it in accordance with the Australian Privacy Principles.

You can delete your account and all associated data at any time via Settings → Delete Account. This action is permanent and cannot be undone.

15. Data Breach Notification

In the event of a data breach that is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner (OAIC) as required by the Notifiable Data Breaches scheme under the Privacy Act 1988. Notification will include the nature of the breach, the information involved, and recommended steps you should take.

For users outside Australia, we will comply with applicable data breach notification laws in your jurisdiction (e.g., GDPR breach notification for EU users, state breach notification laws for US users).

16. Third-Party Services

Clockwork Meal relies on the following third-party services:

  • Anthropic (Claude AI) — Generates meal plans, recipes, and shopping lists
  • Supabase — Authentication and database hosting
  • Stripe — Web payment processing
  • Apple — iOS app distribution and in-app purchases

We are not responsible for outages, errors, or data handling by third-party services. Each operates under its own terms and privacy policy.

17. Intellectual Property

The Clockwork Meal app, branding, design, and underlying technology are owned by us and protected by intellectual property laws. You are granted a limited, non-exclusive, revocable licence to use the service for personal, non-commercial purposes.

AI-generated meal plans and recipes are provided for your personal use. You may save, print, and share them with your household. You may not republish, resell, or commercially exploit AI-generated content at scale.

18. Feedback & Suggestions

If you submit feedback, feature requests, or suggestions, you grant us an unrestricted, irrevocable, royalty-free licence to use, modify, and incorporate those ideas into the service without obligation to compensate or credit you. Do not submit feedback if you do not agree to this.

19. Service Availability

We aim to keep Clockwork Meal available at all times but do not guarantee uninterrupted access. The service may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice where practicable)
  • Unscheduled outages of our infrastructure or third-party providers
  • AI provider downtime (Anthropic)
  • Connectivity issues beyond our control

We are not liable for any loss or inconvenience caused by service unavailability. If a paid subscription is materially affected by extended downtime, contact us to discuss a credit or refund.

20. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim arising from or related to the service is limited to the amount you paid us in the 12 months preceding the claim, or A$50, whichever is greater.

We are not liable for indirect, incidental, consequential, or punitive damages, including but not limited to adverse health outcomes from reliance on AI-generated content.

Australian Consumer Law notice: Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Competition and Consumer Act 2010 (Cth) or any other applicable law that cannot be excluded, restricted, or modified by agreement. If we fail to comply with a consumer guarantee, you are entitled to the remedies set out in the Australian Consumer Law.

21. Disclaimer of Warranties

To the extent permitted by law, the service is provided "as is" and "as available" without warranties of any kind. We do not warrant that the service will be uninterrupted, error-free, or that AI-generated content will be accurate, complete, or suitable for your needs.

This disclaimer does not affect your rights under the Australian Consumer Law, which provides non-excludable consumer guarantees including that services are provided with due care and skill.

22. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages arising from: your breach of these Terms; your provision of inaccurate allergy or dietary information; or your use of the service in a manner inconsistent with these Terms.

23. Termination

We may suspend or terminate your account if you breach these Terms, abuse the service, or pose a risk to other users. You may terminate your account at any time by deleting it via Settings.

Upon termination, your right to use the service ceases immediately. We may retain anonymised, aggregated data for analytics purposes. All personal data will be deleted in accordance with our Privacy Policy and applicable law.

24. International Users

Clockwork Meal is available internationally. If you access the service from outside Australia, you are responsible for compliance with your local laws.

We acknowledge that users in different jurisdictions may have consumer protection rights that cannot be overridden by contract:

  • European Union / UK: If you are a consumer in the EU or UK, you retain all mandatory consumer rights under EU/UK consumer law, including the right to a 14-day cooling-off period for online purchases, and your rights under the GDPR. Nothing in these Terms limits those rights.
  • India: If you are a consumer in India, your rights under the Consumer Protection Act 2019 and the Information Technology Act 2000 apply. These Terms do not limit those rights.
  • United States: If you are in the US, applicable state consumer protection laws apply. We do not require binding arbitration or class action waivers.
  • Other jurisdictions: If your local law provides mandatory consumer protections that conflict with these Terms, your local law prevails to the extent of the conflict.

25. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the non-exclusive jurisdiction of the courts of New South Wales. Nothing in these Terms limits your right to bring proceedings in your local jurisdiction if permitted by law.

26. Force Majeure

We are not liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control, including but not limited to: natural disasters, pandemics, war, terrorism, government actions, power failures, internet or telecommunications outages, AI provider outages, cyberattacks, or changes in law or regulation.

27. Electronic Communications

By creating an account, you consent to receiving electronic communications from us, including:

  • Transactional emails (account verification, password resets, payment receipts)
  • Service notifications (plan generated, subscription changes, security alerts)
  • Product updates and announcements (you may opt out of non-essential communications)

Transactional and security-related communications cannot be opted out of while your account is active. We comply with the Spam Act 2003 (Cth) and provide an unsubscribe mechanism for all marketing communications.

28. Changes to Terms

We may update these Terms from time to time. For material changes, we will notify you via email or in-app notification at least 14 days before the changes take effect. Continued use of the service after the effective date constitutes acceptance of the updated Terms.

We recommend reviewing these Terms periodically. The "last updated" date at the top indicates the most recent revision.

29. Assignment

We may assign or transfer these Terms, and our rights and obligations under them, to a third party (for example, in the event of a merger, acquisition, or sale of assets). We will notify you of any such assignment. You may not assign your account or any rights under these Terms without our prior written consent.

30. Severability & Entire Agreement

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions will continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the service. They supersede all prior agreements, understandings, and representations. No waiver of any provision shall be deemed a continuing waiver or a waiver of any other provision.

32. Apple App Store

If you access Clockwork Meal through the Apple App Store, the following additional terms apply:

  • These Terms are between you and Clockwork Meal Pty Ltd, not Apple. Apple is not responsible for the service or its content.
  • Apple has no obligation to provide maintenance or support for the app.
  • In the event of a failure to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any). Apple has no other warranty obligation.
  • Apple is not responsible for any third-party claims relating to the app.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
